[4. Public Hearing and Action Items ]

HEARING AND ACTION ITEMS. HOLD A PUBLIC HEARING AND MAKE A RECOMMENDATION TO CITY COUNCIL ON AMENDMENTS TO CHAPTER 1 25, ARTICLE THREE AND TITLE ZONING REGULATIONS OF THE CODE OF ORDINANCES OF THE CITY OF LEAGUE CITY RELATED TO MOBILE FOOD VENDORS.

UM, CHRIS, I THINK YOU'RE UP.

YES, SIR.

I'M HAPPY TO GIVE YOU A BRIEF PRESENTATION ON THIS.

SO THIS ITEM'S DIRECTLY RELATED TO OUR LAST LEGISLATIVE SESSION.

UM, THE STATE LEGISLATURE, UM, CREATED HOUSE BILL 28 44, WHICH BASICALLY TOLD US THAT WE COULD NO LONGER PERMIT FOOD TRUCKS AND RESTRICTED OUR ABILITY TO REGULATE THEM ON SOME LEVEL.

SO THE PERMITTING IS NOW TAKEN OVER BY THE STATE.

THAT INCLUDES PERMITTING AND INSPECTIONS OF THESE MOBILE FOOD VENDORS.

UM, AND SO THAT GOES INTO EFFECT JULY 1ST.

AND SO WE ARE HERE REQUESTING A AMENDMENT TO THE CODE TO BE CONSISTENT WITH THAT STATE LAW.

UM, SO BASICALLY THE CHANGES TO THE ORDINANCE, UM, THE, OBVIOUSLY THE REQUIREMENT THAT THEY PERMIT THROUGH THE CITY WAS REMOVED.

UM, WE DID SOME JUST MINOR RESTRUCTURING TO THE ORDINANCE.

UM, DIDN'T REALLY ADD ANYTHING, UM, BUT JUST RESTRUCTURED IT.

RESTRUCTURED IT IN A WAY THAT WAS EASIER TO READ.

AND WE MAINTAINED ALL THE OPERATIONAL STANDARDS THAT WE HAD PREVIOUSLY OUTSIDE OF THE PERMITTING REQUIREMENTS.

UM, SO BASICALLY, UM, WE RESTRICT MOBILE FOOD VENDORS TO TWO LOCATIONS.

THAT'S EITHER IN A FOOD TRUCK PARK, WHICH REQUIRES AN SUP TO BE APPROVED BY COUNCIL IF THEY'RE GONNA GO THERE OR AT A SPECIAL EVENT.

AND SO IF THEY'RE AT A SPECIAL EVENT, THERE ARE CERTAIN REQUIREMENTS THAT ARE IN PLACE.

THEY HAVE TO HAVE OWNER PERMISSION.

THERE'S A DURATION NOT LONGER THAN THREE DAYS, UNLESS APPROVED BY THE CITY MANAGER.

UM, THEY CAN'T BE IN ANY REQUIRED PARKING SPACES FOR THAT USE.

CAN'T BE IN ANY FIRE LANES, HAVE TO ABIDE BY THE NOISE ORDINANCE IF THEY'RE SELLING ALCOHOL.

GOTTA HAVE A PERMIT FROM TABC.

UM, AND THEN IT HAS TO BE INCIDENTAL TO THE PRIMARY USE OF THE PROPERTY.

UM, OB OBVIOUSLY WE'RE BRINGING THIS FORWARD, SO WE'RE RECOMMENDING, UM, UH, APPROVAL OF THE REQUEST.

REALLY LIKE, UH, YOU KNOW, UH, WE GO TO THE BALLPARK A LOT AND HOW DOES THAT CHANGE? LIKE, SOME OF THE FOOD VENDORS, THEY GOT SNOW CONES, STUFF LIKE THAT.

I MEAN THAT A SPECIAL USE PERMIT.

UM, 'CAUSE THAT'S NOT A NO.

SO THEY, THEY WOULD NOT BE ABLE TO PERMANENTLY LOCATE THERE? WELL, OF COURSE, BUT IF THE BALLPARK IS HAVING SOME SORT OF EVENT, UM, A BIG TOURNAMENT, SOMETHING LIKE THAT, UM, THAT COULD BE CONSIDERED AS A SPECIAL EVENT AND ALLOW THEM THOSE, UH, MOBILE FOOD VENDORS.

SO NOTHING CHANGES, NOTHING CHANGES FROM WHAT IT IS TODAY AS FAR AS AN OPERATIONAL STANDPOINT.

JUST THE STATE TAKES OVER VERSUS THE CITY? YES SIR.

AND SO DOES THE STATE TAKE OVER THE GAL THE COUNTY'S HEALTH DEPARTMENT'S INSPECTION PROCESS AS WELL? I BELIEVE THAT IS CORRECT.

MICHELLE, LOOKING AT YOU? YES.

THEY ALSO HAVE WAYS TO DO, UM, SOME OF THE RULES ARE STILL BEING IN PROCESS, KIND OF BUILDING THE PLANE WHILE IT'S IN THE AIR.

AND SO THERE'S GOING TO BE, I WOULD IMAGINE SOME INTERLOCAL AGREEMENTS OR SOME DELEGATION FROM THE STATE TO KIND OF TAKE A LOOK AT THINGS.

WE STILL DO HAVE THE ABILITY TO REGULATE OTHER THINGS OR TO, I SAY REGULATE, TO CHECK THINGS LIKE FIRE SAFETY, THAT SORT OF THING.

AND SO WE DO STILL HAVE SOME AUTHORITY.

IT'S JUST WE CAN'T, UH, PROVE IT THROUGH A, A FORMALIZED PERMIT.

JUST DON'T HAVE ANY, UM, ITEMS THAT WENT TO COUNCIL THAT Y'ALL HAVE SEEN LATELY, BUT, UM, JUST WANNA LET YOU KNOW THAT, UM, MARK DID LEAVE A MONTHLY REPORT ON YOUR DAIS.

AND JUST A QUICK NOTE TO THAT.

UM, SO FROM A HOUSING STARTS PERSPECTIVE, THIS HAS BEEN THE, THE BUSIEST YEAR WE'VE SEEN IN THE PAST DECADE.

UM, SO WE'RE REALLY GETTING A TON OF HOUSING STARTS OVER ON THE WEST SIDE OF TOWN IS WHERE THE MAIN CONCENTRATION OF THEM ARE.

A COUPLE NEIGHBORHOODS ON THE EAST SIDE, DAVIS HARBOR TOWN, HARBOR STATES THAT ARE KIND OF FILLING THOSE IN.

BUT THE VAST MAJORITY OF THIS IS ON THE SOUTHWEST SIDE OF TOWN.

SO WE'RE SEEING A LOT OF GROWTH.

UM, ANTICIPATE, YOU KNOW, AS THE GRAND PARKWAY STARTS TO BREAK GROUND OVER THE NEXT YEAR, UM, THAT GROWTH WILL CONTINUE TO EXPLODE.

WE'LL, WE'LL, ONCE THE HOUSES ARE THERE, WE'LL CAN GET SOME COMMERCIAL GROWTH OVER THERE AS WELL.

SO JUST A QUICK UPDATE.
