ALL RIGHT. I'D LIKE TO INTRODUCE PASTOR ROB BAILEY WITH SOUTHLAKE CHURCH FOR INVOCATION WITH THE PRAYER AND. FOR THOSE WHO CAN WELCOME YOU TO STAND. WELL, IT IS AN HONOR TO BE HERE. AND I DO REALIZE PART OF LEAGUE CITY, WE HAVE MANY PEOPLE WHO LIVE HERE WHO HAVE DIFFERENT UNDERSTANDINGS OF WHO GOD IS. BUT AS A CHRISTIAN PASTOR, I DO PRAY THE NAME OF JESUS. I WELCOME YOU TO MEDITATE AND JUST TO PRAY IN YOUR OWN AS I PRAY RIGHT NOW. HEAVENLY FATHER, AS WE JUST TOOK YESTERDAY TO REMEMBER THE LIVES THAT WERE GIVEN TOMAKE THIS SUCH A GREAT NATION. FROM THE MOST RECENT THE LAST COUPLE MONTHS TO THOSE OVER THE YEARS, LORD, BE WITH THOSE FAMILIES AND BE WITH OUR COMMUNITY. LORD, I ASK, MAY YOUR HOLY SPIRIT BE UPON THIS MEETING TONIGHT. MINIMUM STANDARD WOULD INCLUDE SWING SETS WITH SLING AND BUCKET SEATS, A 3 TO 5 YEAR OLD PLAYGROUND THAT HAS SUFFICIENT PLAY VALUE TO IT, A 6 TO 12 YEAR OLD PLAYGROUND WITH SUFFICIENT PLAYGROUND VALUE AND SEATS, AND ALSO A CLIMBING STRUCTURE. COUNCIL APPROVED SEVEN ONE ON MAY 12TH. MOVE TO APPROVE. MISS CRUZ. THANK YOU. MAYOR. I WON'T TAKE VERY LONG ON THIS. I YOU KNOW, I BASICALLY SAID ALMOST EVERYTHING I HAD AT THE LAST MEETING SO THERE'D BE NOTHING NEW THAT I COULD BRING UP THERE. BUT WHAT I DID WANT TO SEE IS THERE MAY BE A WAY THAT WE CAN GET THIS EXACT ORDINANCE, BECAUSE I AGREE WE NEED TO HAVE THINGS IN PLACE. THERE WAS JUST THAT ONE PART ABOUT THE WRITTEN APPROVEMENT THAT WAS THE WRITTEN AUTHORITY. THAT WAS KIND OF A DIFFICULT IN REALITY. SO HERE WAS MY IDEA. SO INSIDE OF OUR HEALTHY SPACES THAT WE'RE CREATING, THAT WE WOULD HAVE SAFE SPACES AS WELL. AND SO WHAT I WOULD CONSIDER SAFE SPACES WOULD BE IF THERE'S ANY CHURCH NOT FOR PROFIT, OR IF THERE IS A PRIVATE PROPERTY OWNER WHO FEELING LIKE IT'S THEIR DUTY OR THEIR CHRISTIAN OBLIGATION WOULD HAVE ALREADY AHEAD OF TIME, TALKED TO THE CITY MANAGER AND THE CHIEF OF POLICE AND SAID, HEY, WE ARE OKAY WITH SOMEBODY STAYING ON THIS PROPERTY. NOW, I WOULD NOT WE DON'T WANT TO HAVE THIS BECOME CAMPGROUNDS. WE DON'T WANT TO HAVE ANYTHING LIKE THAT. THIS WOULD BE LIMITED TO NO MORE THAN TWO NIGHTS, BECAUSE THE IDEA IS TO TRY TO GET THEM OUT OF THIS EMERGENCY SITUATION AND TO FIGURE OUT AN OPTION. OTHER THAN THAT, YOU KNOW, THAT'S THAT'S THIS IS WHAT OUR GOAL SOULD BE. WHAT I WOULD ALSO LIKE IS THAT IF WE'RE GOING TO HAVE THESE. NOW, GRANTED, I KNOW THAT WE DON'T HAVE ANY KIND OF REALLY CAMPS OR HOMELESS THINGS ANYWAY RIGHT NOW, BUT IF WE'RE GOING TO HAVE THIS, I WOULD SAY FOR THESE SAFE SPACES THAT THE PD CAN WILL ADD THIS TO THEIR TO THEIR NIGHTLY PATROL, WHERE THEY'LL DO WELFARE CHECKS AND MAKE SURE THAT WHOEVER'S THERE KNOWS THAT THEY ONLY HAVE TWO DAYS. THEY CAN ALSO EDUCATE JUST BY A CARD OR WHATEVER OF THE RESOURCES AVAILABLE TO THEM. AND, YOU KNOW, IN THE SAME WOULD BE, YOU KNOW, FOR, FOR THE CARS, WE'D HAVE TO WORK OUT THE DETAILS ABOUT EXACT LOCATIONS THAT WOULD BE ALLOWED OR WHATEVER. BUT THAT WOULD BE PART OF IF THE CHURCH OR THE PRIVATE PROPERTY WANTS TO AGREE TO THIS. AND IF NOBODY DOES, THEN IT JUST DOESN'T GO ANYWHERE. BUT IT DOES GIVE THEM THE OPTION. AND THEN WITH THAT OPTION, WE'D HAVE CERTAIN AREAS. I WOULD ALSO SAY THAT IF WE HAVE SITUATION WHERE WE DO HAVE TO, YOU KNOW, FORCIBLY REMOVE THEM, THAT IF THEY DO HAVE AN ANIMAL THAT RATHER THAN JUST THE ANIMAL GET, YOU KNOW, RELEASED THAT WE COULD THAT IF IT'S IN LAKE CITY THAT THE ANIMAL WOULD GO TO THE LEAGUE CITY SHELTER FOR A, YOU KNOW, A SHORT PERIOD OF TIME. I DON'T KNOW HOW LONG, BUT IT WOULD BE SHORT. THE, THE INDIVIDUAL COULD THEN COME PICK UP THEIR DOG AT NO FEE. AND IF WHATEVER THE TIMELINE WE HAVE, IF THEY DON'T PICK IT UP, THEN IT FOLLOWS THROUGH THE NORMAL. THE NORMAL. ADOPTION PIECES. SO THIS WOULD. THIS WOULD KEEP IN PLACE EVERYTHING THAT WE'RE TRYING TO DO. THIS WILL NOT

HAVE THE CITY ALLOWING OR, OR ALLOWING, YOU KNOW, ANY KIND OF A CAMP OR ANYTHING LIKE THAT, BECAUSE THAT'S NOT WHAT THIS IS FOR. WHAT I'M TALKING ABOUT IS JUST FOR THOSE FEW EXCEPTIONS, BUT RATHER THAN HAVE TO HAVE A WRITTEN NOTICE UP FRONT THAT THEY HAVE THAT THE CITY HAS A AUTHORITY BASICALLY AHEAD OF TIME SAYING, HEY, WE WILL ALLOW PEOPLE TO DO THIS NOW THAT WILL BE REVOKED. AND, YOU KNOW, IF THEY WANT TO AT ANY TIME. AND FOR THE TWO DAYS, I, I WOULD SAY THAT WE'D SET A TIMELINE, MAYBE SOMETHING LIKE THEY CAN'T COME BACK FOR 14 OR 21 DAYS OR SOMETHING LIKE THAT. SO THAT IS SOMETHING THAT I WOULD LIKE TO SEE COMING ON. I THINK THAT IT ALLOWS BOTH OF WHAT WE'RE TRYING TO DO, AND IT ALLOWS PEOPLE WHO ARE FEELING THAT THEY SHOULD TRY TO DO A CHRISTIAN DUTY, AND ESPECIALLY SOME OF THE CHURCHES OUT THERE, IF THEY DON'T WANT TO DO IT, FINE, THEY DON'T HAVE IT. AND WE JUST FOLLOW THE EXACT LETTER OF THE LAW AS YOU'VE LAID IT OUT. AND THIS ORDINANCE. SO IF IF INTERESTED IN THIS, THEN I'M GOING TO ASK NOW FOR A. FOR US TO DELAY VOTING ON THIS FOR AT LEAST TILL THE NEXT MEETING SO THAT I CAN GET WITH MICHELLE, OR WE CAN ALL GET WITH MICHELLE TO KIND OF DRAFT UP SOME LANGUAGE AND MAKE SURE THAT THE IDEAS ARE LEGAL. SO I DON'T PLAN ON DEBATING ANYTHING ELSE FURTHER THAN THIS. IF YOU'RE INTERESTED, I WOULD LIKE TO ASK FOR A POSTPONEMENT, AT LEAST TO THE NEXT MEETING FOR THIS. OKAY, THAT'S A PREVAILING MOTION. I ALSO KNOW THAT WE COULD NEVER POSSIBLY THINK OF ALL THE SCENARIOS WHERE WE'D WANT TO AN EXCEPTION TO THIS POLICY. AND IF WE START TRYING TO WRITE THEM, THEN IT IMPLIES THAT THERE ARE NO OTHER SITUATIONS WHERE WE WOULD WANT THEM TO USE DISCRETION. THIS IS BEING PASSED TO HANDLE SITUATIONS THAT ARE PROBLEMATIC, NOT WHERE THERE IS SOMEBODY WHO'S TEMPORARILY GETTING THEMSELVES OUT OF A BAD SITUATION. AND GOING TO A BETTER ONE. THAT'S NEVER BEEN THE POINT OF THIS. AND THAT'S NOT THE TYPE OF OF SITUATION THIS IS MEANT TO ADDRESS. AND IT'S NOT WHAT OUR POLICE DEPARTMENT IS GOING TO DO. THERE HAVE NO ISSUE WITH IT AND THEY'RE NOT CAUSING A PROBLEM. SO I'M GOING TO CONTINUE TO TRUST OUR POLICE DEPARTMENT TO, TO USE OUR JUDGMENT AND APPLY THIS WHEN IT'S FOR THE BETTERMENT OF THE COMMUNITY, AND NOT WHEN IT WOULD BE A PROBLEM FOR SOMEBODY WHO ISN'T A PROBLEM. ONE QUICK THING BACK TO LIKE I SAID, I DON'T WANT TO GET INTO A LONG DEBATE. I KNOW HOW THIS IS GOING TO VOTE. IT'S GOING TO GO. BUT AS FOR MR. TRESSLER SAID THAT OUR POLICE DEPARTMENT IS FANTASTIC AND THEY ALWAYS GET PERFECT NOTES. AND I ABSOLUTELY JUST FEEL PERFECTLY SAFE. AND I THINK MOST CITIZENS FEEL THAT WAY TOO. THIS ISN'T ABOUT THE POLICE DEPARTMENT. THIS IS ABOUT WHETHER WE'RE OPERATING BECAUSE THIS IS WE'RE IF THEY WANT TO ENFORCE TO THE LETTER OF THE LAW, THAT'S THE THAT'S THE CONCERN IS WHAT THE LETTER OF THE LAW IS NOT WHAT THE NOT WHAT WE NOT THE FREEDOM THAT WE GIVE THEM. CONSIDERING TO TAKE ACTION ON A RESOLUTION ESTABLISHING THE CITY'S DEFAULT POLICY OF NON APPROVAL FOR HOUSING FINANCE CORPORATION PROJECTS WITHIN LEAGUE CITY TO APPROVE. MOVE TO APPROVE. CAN WE GET THE PITCH ON THIS? PUT THIS ON. YEAH I PUT IT ON. THIS WAS IF YOU REMEMBER THESE ARE THERE'S A COUPLE THINGS THAT COULD HAPPEN. BUT WE HAD SOME OUTSIDE HOUSING CORPORATIONS FROM AROUND THE STATE DOING HOUSING FINANCING IN LEAGUE CITY, WHICH THEN TAKES THOSE APARTMENT COMPLEXES OFF THE TAX ROLLS. AND SO, YOU KNOW, THAT THAT, THAT HIT US FOR, I DON'T KNOW, A COUPLE MILLION DOLLARS WORTH OF WORTH OF TAXES IN THE LAST COUPLE OF YEARS. AND NEW CITY LAW OR THE NEW STATE LAW HAS ADDRESSED SOME OF THIS, BUT WE STILL HAVE A COUPLE OF YEARS TO GET THOSE BACK ONTO THE TAX ROLLS. SO IT WILL IT'LL TAKE A WHILE TO FIX THE PROBLEM, BUT LET'S NOT MAKE THE PROBLEM WORSE GOING FORWARD. ALL RIGHT. PLEASE VOTE. MOTION

SOME OF OUR PUBLIC ACCESS WAYS AND SUCH THAT IT GIVES US THE ABILITY TO REMOVE THE PROPERTY QUICKER WITHOUT HAVING TO WORRY ABOUT IT. THE ONLY TIME THAT WE WOULD WORRY ABOUT NOT TRYING TO LOCATE A LEGITIMATE OWNER, IF WE BELIEVE THAT IT'S ACTUALLY SOMEBODY'S PROPERTY, IS IF IN THE CASE OF BIOHAZARD OR PERISHABLES, THOSE TYPES OF THINGS. SO AGAIN, IT ALWAYS BE BASED ON THE TOTALITY OF CIRCUMSTANCES, NOT A BLANKET OR NOT A BLANKET REGURGITATION OF WHAT'S WRITTEN ON THE PAGE. SO BEFORE WE TALK ABOUT HOW WE WOULD GET NEW BOND DEBT FOR FOR B DEBT FOR THE 49.7, WE JUST WANTED TO MENTION THAT CONTINGENCY MATERIALS TESTING WOULD BE CASH FUNDED, MAINLY FROM THE MONEY THAT WE GOT FROM THE SILVERADO. AND IF IT'S NOT NEEDED, WHAT HAPPENS TO THAT MONEY? IT WOULD BE RETURNED TO THE PROGRAM, TO THE GENERAL FUND. DEPENDING ON EXACTLY WHAT MONEY IS USED VERSUS NOT SPENT, IT WOULD HAVE WE WOULD LOOK AT THE LEGAL PURPOSE AND IT WOULD BE RETURNED TO THE CIP. SO THE TOTAL FUNDING OF THE 49.7. THE TREE PRESERVATION FUND HAS AN ESTIMATED BALANCE OF 300,000. WE WOULD USE 100% OF THAT BALANCE. SO IF IT ENDED UP BEING 315,000, WE WOULD USE THAT TOWARDS TREES. WHATEVER'S LEFT OVER WOULD BE THE DEBT ISSUANCE. AT THIS MOMENT, WE BELIEVE IT'LL BE THE 49.5 MILLION THAT YOU SEE ON THE SCREEN. WE RAN A MODEL AT 25 YEARS AT AN ESTIMATED 4.5% INTEREST, AND YOUR ANNUAL PAYMENT WOULD BE 3.338 MILLION A YEAR. THIS WOULD BE PAID FOR WITH THE FOUR B SALES TAX. $5.4 MILLION. IT'S PROGRAMED IN THE CURRENT CIP WITH 4BA DEBT FUNDING AND 2027. WE WOULD ACTUALLY MOVE THAT TO BE PART DEDICATION FUNDED. THE LYNN GRIFFIN PARK SHORELINE PROTECTION AT 300 000. IT'S ALSO PROGRAMED FOR 2027 IN THE CIP FROM PARK DEDICATION FEES.

WE WOULD POSTPONE THAT ONE YEAR, BUT IT WOULD HAVE THE SAME FUNDING, THE KILGORE DAVIS TRACK PARK LAND AT 2.7 MILLION. IT'S PROGRAMED IN THE CURRENT CIP IN 2027 FROM PARK FEES. THE ACTION THAT WOULD NEED TO BE TAKEN IS THAT WE WOULD SPLIT IT INTO TWO PHASES, WHICH I BELIEVE THE PRELIMINARY DESIGN KIND OF ALREADY CALLS FOR THAT ONE IS FOR TRAILS. THAT WOULD BE THE DESIGN AND CONSTRUCTION OF THAT FIRST PHASE IN 2027. AND THE SECOND PHASE WOULD BE THESE OVERLOOKS, AND THAT WOULD BE POSTPONED TO 2028 AND WOULD ALSO HAVE THE SAME FUNDING OF PARK DEDICATION FEES. IN THE PLAN, WE HAVE WALKER POOL RENOVATIONS AT 4.3 MILLION.

IT'S RECENTLY STARTED DESIGN FROM FOUR B CASH. WE WOULD ACTUALLY PAUSE THE DESIGN AND POSTPONE THE RENOVATIONS UNTIL FUNDS ARE AVAILABLE FROM THE FOUR B AND OUR PARK DEDICATION FEES. SOME OF THE WAYS THAT THAT WOULD COME ABOUT IS IF SALES TAX COMES IN AT A HIGHER PERCENTAGE OF GROWTH THAN WHAT WE ESTIMATED. ANOTHER OPTION COULD BE WHETHER IT BE THE CONTINGENCY THAT THE MAYOR JUST MENTIONED, OR ANOTHER PARKS PROJECT THAT HAS CONTINGENCY THAT'S FREED UP, THEN WE WOULD BRING THAT BACK TO COUNCIL WHEN FUNDING IS AVAILABLE TO CONTINUE WITH THE PROJECT. SHOULD WE EVEN START WITH THE DESIGN IF WE'RE GOING TO POSTPONE IT? I THINK IT JUST STARTED AND WE WOULD PUT A PAUSE ON THAT. BECAUSE THERE'S TWO OTHER PROJECTS THAT WERE BROUGHT FORTH AS PART OF THE FOUR B PROGRAM. FOR 27 THROUGH 31. IT'S ABOUT 2.5 MILLION. IT'S A NEW PROJECT FOR CONSIDERATION. IT IS CURRENTLY BEING CONSIDERED FOR THE NEXT FIVE YEAR PROGRAM. IT WAS TO BE PROGRAMED FROM PARK DEDICATION FEES. THE DESIGN WOULD BE IN 27 AND CONSTRUCTION WOULD BE FOLLOWING IN 2028. SPORTSPLEX LIGHTING AT 1.9 MILLION FOR B FUNDING AND PARK DEDICATION FEES ARE PROGRAMED ON OTHER PROJECTS, AND SO WE DON'T HAVE IDENTIFIABLE FUNDING FOR THIS LIGHTING PROJECT AT THIS TIME. SO OUR ACTION WOULD BE JUST POSTPONE IT UNTIL FUNDING ALLOWS. AND WE WOULD ALSO ADD IT TO THE FUTURE PROJECTS LIST. SO SIMILAR TO THE POOL, IT WOULD JUST GET IN THE QUEUE WHEN FUNDING ALLOWS. AND THEN GOING FORWARD, JUNE 9TH IS OUR INTERNAL DEADLINE FOR AD ALTERNATES AND FUNDING STRATEGIES TO BE APPROVED BY COUNCIL, MEANING WE JUST NEED YOUR YOUR FEEDBACK SO WE KNOW WHAT WE NEED TO MOVE FORWARD WITH.
