IT'S NOT ABOUT REGULATING WHO LIVES ON THEIR BOATS AND HOW THEY LIVE ON THEIR BOATS.
THIS ORDINANCE IS DESIGNED TO KEEP PEOPLE FROM LIVING ON THEIR BOATS.
WHEN YOU READ IT, THERE'S A STRICT AND STRENUOUS APPLICATION PROCESS THAT INVOLVES INVASIVE SEARCHES AND NEAR IMPOSSIBLE TIMELINES TO APPLY FOR THE PERMIT.
AND AFTER ALL THAT, THE ORDINANCE DOUBLES DOWN ON AN OPEN-ENDED DENIAL CLAUSE.
IF YOU FAIL TO GET A PERMIT THE FIRST GO ROUND, YOU ARE NOT ALLOWED TO GET ANOTHER PERMIT FOR 12 MONTHS.
THIS IS FORCING PEOPLE THAT LIVE IN HOMES OUTTA THEIR HOME.
IF YOUR PERMIT IS DENIED AT ANY POINT IN TIME, YOU CAN BE DENIED GETTING ANOTHER PERMIT, WHETHER YOU FIX THE ERROR OR NOT.
AND THIS ISN'T ABOUT SAFETY, HEALTH, OR ENVIRONMENT.
IT COULD BE ABOUT DOCUMENTATION IF SOMEONE'S NAME IS SPELLED WRONG OR IF THE COAST GUARD COULDN'T GET TO THEIR VESSEL IN TIME.
THAT REMOVES SOMEONE FROM THEIR HOMES AND LISTEN TO WHAT I'M SAYING, HOMES NOT VESSELS.
AND THIS ORDINANCE HAS DOUBLED DOWN IN THAT OUTSIDE OF JUST THAT PORTION OF IT IS THE, THE TIMEFRAMES THAT ARE INVOLVED IN THIS.
I WAS AT THE BOAT SHOW THIS WEEKEND, SETTING UP FOR TOWBOAT US AND I WENT OVER AND TALKED TO THE COAST GUARD AUXILIARY ABOUT GETTING AN INSPECTION, SAFETY INSPECTION TO APPLY FOR THIS PERMIT IN A TIMELY MANNER.
AND THEY SAID THERE'S NO POSSIBLE WAY.
THEY SAID, WITH THE PEOPLE THAT ARE ON THE LAKE, THERE'S NO POSSIBLE WAY THAT THEY COULD GET EVERYBODY ON THE LAKE IN COMPLIANCE WITH THIS ORDINANCE IN THE TIME THAT THEY SAY IT'S SUPPOSED TO HAPPEN.
SO Y'ALL THINK TO Y'ALL SELVES, THIS IS REALLY ABOUT SAFETY, ENVIRONMENTAL, OR HEALTH, OR IS IT REALLY ABOUT KEEPING PEOPLE FROM LIVING ON THEIR BOATS? 'CAUSE THAT'S EXACTLY HOW THIS ORDINANCE READS.
IT'S ABOUT KEEPING PEOPLE FROM LIVING ON THEIR BOATS AND DENYING THEM THE ABILITY TO DO IT IN PERPETUAL PERPETUALLY.
IF YOU DENY THEM A PERMIT NOW AND 12, THEY CAN'T APPLY AGAIN FOR 12 MONTHS, THEY'RE HOMELESS.
AT THE END OF THAT 12 MONTHS, THEY GO TO APPLY AGAIN AND YOU CAN DENY THEIR PERMIT BECAUSE IT WAS DENIED THE FIRST TIME, WHETHER THEY'RE IN COMPLIANCE OR NOT NOW.

I'M HERE TO ADDRESS LAKE CITY'S COOPERATION WITH THE US IMMIGRATION AND CUSTOMS ENFORCEMENT AGENCY, OTHERWISE KNOWN AS ICE AND TEXAS OPERATION LONE STAR, LIKE SO MANY OTHER AMERICANS, I'M APPALLED TO WITNESS HOW ICE OFFICERS HAVE TREATED HUMAN BEINGS ACROSS THE COUNTRY IN THE PAST 20 DAYS.
ICE HAS BRUTALLY KILLED THREE US CITIZENS.
ALEX PRETTY MINNESOTA SHOT WHILE UNARMED IN THE BACK, WHILE ON HIS KNEES.
RENEE, GOOD MINNESOTA SHOT IN THE FACE WHEN TRYING TO REMOVE HERSELF FROM ICE ESCALATION.
CALIFORNIA SHOT BY AN ICE OFFICER WHO WAS OFF DUTY AND NOT EVEN PERFORMING OFFICIAL DUTIES.
THIS IS NOT TO MENTION THE MASSIVE NUMBER OF LAW ABIDING RESIDENTS WHO ARE IN THE PROCESS OF BECOMING UNDOCUMENTED INHUMANELY TREATED AND DENIED THEIR DUE PROCESS RIGHTS AFFORDED BY THE US CONSTITUTION.
IT MADE ME WONDER HOW HAVE OFFICIALS IN MY HOME LEAGUE CITY WORKED WITH THIS AGENCY THAT EMPLOYS THESE TYPES OF INDIVIDUALS.
ON AUGUST 26TH OF LAST YEAR, THIS COUNCIL, AFTER TWO MINUTES AND 32 SECONDS OF DISCUSSION UNANIMOUSLY VOTED TO PARTICIPATE IN SECTION 2 87 G OF THE IMMIGRATION AND NATIONALITY ACT, WHICH ALLOWS ICE TO DELEGATE ENFORCEMENT AUTHORITIES TO LOCAL ENFORCEMENT AUTHORITIES, TO LOCAL LAW ENFORCEMENT AGENCIES.
THIS IS NOT REQUIRED BY ANY FEDERAL LAW.

EVENTUALLY A STOP SIGN WAS INSTALLED.

UM, YOU CAN KIND OF SEE 3 95 DASH OH ONE 16 E ONE OF THE WAYS IT ALLOWS US TO COLLECT FEES IS THAT THE CERTIFICATE OF OCCUPANCY.
SO THE CITY CAN CHOOSE WHERE THEY WANT TO COLLECT THIS.
UM, AND IT ALSO ALLOWS FOR US TO ENTER INTO AGREEMENTS THAT ESTABLISH PAYMENT SCHEDULES FOR THESE CAPITAL RECOVERY FEES.
SO AGAIN, ALL PART ONE IS DOING IS A POLICY SHIFT FROM DUE AT TIME OF PERMIT TO DUE AT TIME OF CERTIFICATE OF OCCUPANCY.
SO WHY IT MATTERS, WHAT'S THE BIG THING WITH THAT? IT GOES BACK TO THE CONSTRUCTION LOANS.
SO MOST OF THE, UH, CONSTRUCTION LOANS THAT ARE ISSUED, THEY'RE GETTING 75% THROUGH THE BANK.
UH, WHEN YOU HAVE THOSE FEES DUE AT THE TIME OF PERMITTING, IT'S COMING OUT OF THEIR CONSTRUCTION BUDGET, WHICH THEN JUST SHRINKS THEIR CASH, AVAILABLE CASH FOR THE ACTUAL CONSTRUCTION OF THE SITE.
UM, MOVING IT TO THE CO ALLOWS THEM TO ROLL THAT INTO THEIR BUSINESS LOAN WHEN THEY TRANSITION FROM A CONSTRUCTION LOAN TO A BUSINESS LOAN.
AND IT'S NOT A HUGE IMPACT TO THE CITY.

AND THAT WAY WE KNOW WE'RE GONNA GET OUR MONEY IF THAT DEVELOPMENT FAILS OR IF SOMETHING HAPPENS.
SO WE'RE SECURE IN THAT MONEY AND IT ALSO GIVES US THE ABILITY THEN TO, TO TRY TO GET SOME OF THESE BETTER, UH, COMMERCIAL DEVELOPMENTS, BIGGER, BETTER COMMERCIAL DEVELOPMENTS IN.
SO IT'S NOT REALLY COSTING US ANYTHING.
IT'S HELPING THEM, UH, FINANCE THEIR PROJECT AND MOVE THAT EXPENSE OUT INTO THE FUTURE.
OF COURSE WE WOULD LOSE THE, THE INTEREST ON CARRYING IT, BUT IT'S, WE'RE STILL SECURE WITH THAT BOND BEHIND IT.
AND THEN I THINK REALLY FROM THERE, WHERE THE THREE 80 AGREEMENT COMES IN IS IF IT'S SOMETHING THAT WE ALL AGREE THAT IT'S GREAT, THEN YOU CAN STRUCTURE THE THREE 80 AGREEMENTS AS A WAY OF PAYING OURSELVES BACK THROUGH THE THREE 80.
