I WORK FOR TOWBOAT US, AND THE VAST MAJORITY OF THE BUSINESS THAT WE DO IS WITH THE PEOPLE THAT ARE LIVEABOARDS AND THE BOATING COMMUNITY.

AND I BELIEVE THAT THE LIMITATION OF LIVEABOARDS IN THE MARINAS IS GOING TO HAVE A HUGE IMPACT ON THE BUSINESS THAT WE DO.

I ACTUALLY HAD PLANS ON BUYING THE BUSINESS FROM HOLLY AND PIP, AND THEN MAKING BIG TIME SECOND GUESSES ON PURCHASING THE BUSINESS FROM HOLLY AND PIP BECAUSE OF WHAT THE FUTURE INCOME OF THAT BUSINESS MAY BE.

I ALSO WANTED TO TALK ABOUT THE OTHER BUSINESSES.

IF IN THE ORDINANCE, YOU LIMIT THE LIVEABOARDS TO 15% OF MARINA CAPACITIES, THE TWO PUMPOUT COMPANIES THAT ARE ON THE LAKE, YOU'RE LIMITING THEIR CLIENTELE.

AND IF YOU LIMIT THEIR CLIENTELE, YOU ONLY HAVE TWO OUTCOMES POSSIBLE OUTCOMES.

EITHER YOU'RE GOING TO DRIVE THE PRICE OF THEIR SERVICES UP SO HIGH THAT PEOPLE CANNOT AFFORD OR WILL NOT USE THEIR SERVICES BECAUSE THE PRICE IS HIGH, OR YOU'RE GOING TO LIMIT THEIR SERVICES SO MUCH, THEY'RE NOT GOING TO BE ABLE TO PROFIT ENOUGH TO MAINTAIN THEIR COMPANY.

AND BY LIMITING THE CAPACITY OF THE MARINAS TO 15% ON THE LIVEABOARDS, THERE ARE PEOPLE THAT ARE ABLE TO COMPLY AND ARE WILLING TO COMPLY WITH YOUR ORDINANCE AND GET A PERMIT, BUT BECAUSE Y'ALL ARE LIMITED TO A 15% CAPACITY, THERE ARE PEOPLE THAT FIT IN THAT CATEGORY THAT ARE NOT GOING TO BE ABLE TO STAY.

AND WHEN YOU DISPLACE THEM, YOU'RE TAKING KIDS FROM SCHOOLS, KIDS FROM EXTRACURRICULAR ACTIVITIES.

PEOPLE NEED NEW PHYSICIANS, NEW PHARMACIES.

WE ARE KNOWN AS LIVEABOARD FREE, AND I AM THE INTERIM PRESIDENT OF THIS ORGANIZATION. PLEASE KNOW I'M HERE TODAY AS A CONTINUATION OF THE OLIVE BRANCH TO THE MAYOR AND TO THE COUNCIL. IN SHORT, I'M HERE TO FACILITATE A CONTINUING DIALOG ON HOW WE MIGHT BETTER TUNE THE EXISTING ORDINANCE.

BUT PLEASE KNOW THIS WE ARE PART OF THE SOLUTION AND WE ARE NOT PART OF THE PROBLEM.

I WANT TO MAKE THAT VERY CLEAR. THESE PAST FEW WEEKS, WE HAVE ALL HAD AN OPPORTUNITY TO REFLECT ON THE ORDINANCE AND THE CURRENT PROBLEM EXISTING IN A FEW SELECT MARINAS, NAMELY JMC FIVE.

MY QUESTION IS VERY SIMPLE WHY HAVE WE NOT ALL REALIZED THAT IN FACT, WE ARE ALL ON THE SAME SIDE OF THIS? WHAT IS THAT SIDE? WELL, LET ME TELL YOU, WE ARE ALL ON THE SIDE OF ADDRESSING THE ISSUE OF DERELICT BOATS AND ABANDONED BOATS, WE AGREE WITH THE HOMEOWNERS OF MARINA DEL SOL AND JMC OF THE STATE OF MANY OF THOSE VESSELS IN THAT MARINA ARE IN DISARRAY.

THE SWIMMING POOL LOOKS LIKE THE SWAMP OUT OF LOUISIANA.

THE DOCKS HAVE COME LOOSE AND ARE HELD IN PLACE BY ROPES, AS THOUGH THEY WERE STRUCK BY A CATEGORY FIVE HURRICANE.

IT'S INSANE. AND YES, THERE ARE SOME PEOPLE LIVING ON BOATS IN JMC FIVE THAT HAPPEN TO BE IN LINE WITH WHAT WE DEEM TO BE DERELICT BOATS.

BUT HOW DID WE GET HERE? AND THAT IS THE QUESTION.

WE KNOW THERE ARE RULES IN PLACE AT JMC FIVE AND LET ME READ YOU ONE OF THEM.

THE MARINA RESERVES THE RIGHT TO REMOVE AND SELL SAID CRAFT UNTIL ALL DELINQUENT CHARGES HAVE BEEN PAID IN FULL.

THE LEASE. HE AGREES THAT SHOULD THE ABOVE CONDITION ARISE, THAT THE MARINA WILL IN NO WAY BE HELD LIABLE OR RESPONSIBLE FOR THE LOSS.

AND IT GOES ON. BUT I'M GOING TO SAVE YOU THE TIME. BUT YOU GET THE IDEA OF OF THE OF THE RULE. SO I ASK, HOW MANY OF THESE BOATS HAVE BEEN SEIZED OR REMOVED? WELL, I KNOW OF ONE ATTEMPT IN 2022 WHERE A FAMILY OF FIVE SQUATTED ON A 30 FOOT BOAT.

THEY REFUSED TO PAY NOR STAY WHOLE WITH THE MARINA.

THEY DODGED THE MANAGER AND MADE NO ATTEMPT TO MAKE THEIR STAY CONTRACTUAL.

DAYS BECAME WEEKS, WEEKS BECAME MONTHS.

FINALLY, AFTER ALL PROCESSES WERE FOLLOWED, THE OCCUPANTS CALLED THE POLICE.

INSTEAD OF RECOGNIZING THE PROBLEM, THE OFFICER THREATENED TO ARREST THE MANAGER FOR HARASSMENT. THAT MANAGER HAPPENED TO BE MY WIFE.

THE POINT I AM TRYING TO MAKE IS SIMPLE.

I AM NOT SAYING THE CITY IS WRONG.

I AM NOT SAYING THAT THE POLICE ARE WRONG.

WHAT I'M SAYING IS THAT WE HAVE A MARINA WHO HAS RULES AND THEY DON'T FOLLOW THEM.

HE DOESN'T ENFORCE THE VERY RULES EXPLICITLY WRITTEN INTO THE LEASE AGREEMENT.

WHY DO THE MAJORITY OF MARINAS IN THE LAKE HAVE A MUCH SMALLER PROBLEM THAN JMC FIVE OR THE WHARF? IT'S SIMPLE. THEY ENFORCE THEIR OWN RULES.

SO I RESPECTFULLY ASK YOU THIS.

THAT'S CONTRACTUAL. IT CAN BE CANCELED AT ANY TIME.

CONTRACTUAL. THE SECOND NOW IS A LEGAL DESIGNATION FROM THIS ORDINANCE.

WHAT IT SAYS IS THAT IF YOU STEP FOOT ON THE BOAT FOR AN INSTANT FOR TEN DAYS, YOU MIGHT BE LIVEABOARD.

IF YOU SLEEP ON THE BOAT IN THOSE TEN DAYS, YOU ARE A LIVEABOARD.

IF YOU PREPARE A MEAL WHILE YOU'RE ON THE BOAT, YOU ARE A LIVEABOARD. THAT WOULD INCLUDE A CUP OF TEA.

THAT'S HOW VAGUE THIS ORDINANCE IS.

IT SAYS IF YOU CONDUCT DOMESTIC ACTIVITIES.

CAN ANYONE SIT HERE AND SAY, I KNOW EXACTLY WHAT DOMESTIC ACTIVITIES ARE? IS IT CHECKING YOUR PHONE? IS IT WATCHING TV? IS IT READING A NEWSPAPER? DOES IT INCLUDE CLEANING? SO IF I SPEND TEN DAYS ON MY BOAT CLEANING.

NOW, ACCORDING TO THIS ORDINANCE, I AM A LIVEABOARD.

THAT'S CRAZY. SO IF YOU LOOK AT SOMEBODY WHO OWNS A BOAT AND THEY'RE TRYING TO REPAIR IT, AND THEY'RE TRYING TO GET IT GOING, AND THEY SPEND TEN DAYS IN 30, LET'S SAY THE FIRST TEN DAYS OF THE YEAR ON THAT BOAT.

THEY ARE NOW CLASSIFIED AS A LIVEABOARD FOR THE ENTIRE REST OF THE YEAR.

THERE IS NO WAY THAT ONCE YOU BECOME A LIVEABOARD, YOU CAN STOP BEING A LIVEABOARD THAT YEAR.

AND SO THEN THAT MEANS THAT ANYTIME CODE ENFORCEMENT WANTS TO COME ONTO YOUR BOAT, AND THEY WANT TO SEARCH IT TO MAKE SURE THAT YOU'RE NOT A LIVEABOARD, THEY CAN WALK ON IT. THAT'S RIDICULOUS.

IF IT WAS A MARINA AND A CONTRACT, I CAN STOP BEING A LIVEABOARD BY CANCELING THAT CONTRACT OR TALKING TO THE MARINA.

PROOF OF VESSEL PASSED TO US COAST GUARD INSPECTION OR VESSEL SAFETY CHECK.

THAT'S FINE. HAVE YOU TRIED TO GET ONE OF THEM LATELY? IT TAKES THEM MONTHS, NOT DAYS.

AND THEN SOMETIMES YOU HAVE TO BRING YOUR BOAT TO THEM.

THEY DON'T COME TO YOU.

ON TOP OF THAT, IT ALSO STATES THAT IN LIEU OF THAT, THAT A LAW OFFICER CAN COME MAKE AN INSPECTION.

THEY'RE NOT TRAINED FOR THIS.

DO YOU HAVE THE ABILITY TO COME INSPECT THE BOAT TO SEE IF IT'S SAFE? DO YOU KNOW WHAT'S REQUIRED OF A SAFETY INSPECTION? HE SAID WE DIDN'T EVEN KNOW THIS ORDINANCE WAS GOING TO EFFECT. THIS IS THE FIRST TIME I'VE HEARD ABOUT IT. IT'S NOT FAIR TO PUT SOMEBODY ON A BOAT AND SAY, IS THIS VESSEL SEAWORTHY? IS IT SAFE? IT HAS NO TRAINING IN THAT.

SO I THINK THAT THIS ONE CONTINGENCY HERE SHOULD BE DELETED.

IN ADDITION, THE REAPPLICATION RESTRICTION, IT SAYS IF SOMEBODY DOESN'T PASS THAT THEY CAN'T APPLY AGAIN FOR ANOTHER YEAR.

IT STATES HERE THAT THEY HAVE TO HAVE PERSONNEL TRAINED IN SPILL PREVENTION.

THERE'S NOBODY THAT HAS THAT TRAINING OTHER THAN KNOWING THAT YOU SHOULDN'T PUT IT IN THE WATER. SANITATION AND CLEANLINESS UNDER SEA.

REFUSE, SEWAGE, WASTE AND DEBRIS AND OTHER POLLUTANTS SHOULD NOT BE DEPOSITED IN ANY NEAR, BOAT, SLIP OR WATERWAY.

THE POINT OF MENTIONING ALL THIS IS THAT I DO MY UTMOST TO KEEP THE RESIDENTS CONSISTENTLY INFORMED, AND THERE ARE OCCASIONAL BOIL OVERS CONTAINED BY TAKING ISSUES TO THE CITY IN A CIVIL MANNER. I WOULD LIKE THE SAME COURTESY FROM THE CITY ON A CONSISTENT BASIS FOR PROJECTS THAT IMPACT US, INCLUDING BAY RIDGE DRAINAGE, PHASE FOUR, GUM BAYOU ON THE HORIZON.

THIS IS WHAT MARICA WAS REFERENCING THEM.

THEIR DRIVEWAY IS THE ROAD HAS BEEN TORN UP, AND IT WAS INTENDED TO GO JUST THROUGH THE FIRST HALF OF THEIR TWO CAR DRIVEWAY.

SO WE NEED TO CORRECT THAT FOR THEM.

THE PEOPLE WHO LIVE ON THEIR BOATS, OR EVEN THE PEOPLE WHO ARE NOW MADE LIVEABOARDS THROUGH THIS ORDINANCE. WE ARE THE PEOPLE WHO ARE MONITORING THE MARINAS.

WE LIVE THERE. WE WANT THINGS TO BE KEPT WELL.

WE CHOOSE MARINAS. WE PAY FOR SLIP FEES.

WE PAY FOR SERVICES OF BUSINESSES LIKE THE PUMP OUTS, THE GENTLEMAN WHO WASHED THE BOATS IN THE WINTER TIME, BECAUSE I DON'T WANT TO DO THAT WHEN I COME HOME FROM SCHOOL.

WE ARE CONTRIBUTING MEMBERS OF THE COMMUNITY, WE CONTRIBUTE TO BUSINESSES, AND WE MONITOR WHAT'S GOING ON AROUND US.
