HOWEVER, IN THE SUBDIVISION PORTION OF OUR ORDINANCE, IT SAYS, OKAY, WHEN YOUR LOT BACKS UP TO THE SIDE OF AN ADJACENT LOT, AS YOU CAN SEE IN THIS LOCATION, THAT SETBACK GOES FROM 10 FEET TO 25 FEET. AND THE IDEA BEHIND THAT IS THAT THE PER, BASICALLY, THE REAR LOT WHEN THEY COME OUT, YOU'RE TRYING TO LINE UP ALL OF THE, THE, UH, STRUCTURES TOGETHER. SO EFFECTIVELY THE, THE MOST COMMON, UH, VERBIAGE WE SAY IS SO SOMEBODY DOESN'T WALK OUT THEIR DOOR AND LOOK AT THE BACK OF SOMEBODY'S HOUSE. YOU CAN SEE KIND OF THE AREA, UM, WITH RESPECT TO BEING ABLE TO MEET THE ROOF LINE IN WITH THE STRUCTURE. UM, YOU KNOW, WHERE IT DOESN'T BECAUSE OF THE PALLADIAN WINDOW ON THE SECOND FLOOR AND THEN THE BUMP OUT ON THE OTHER SIDE OF THE HOUSE BASED ON STAFF'S FINDINGS, THE DEER, IT DOES APPEAR THAT ALL TESTS HAVE BEEN MET. AND AGAIN, ALTHOUGH THE HOUSE IS BUILT INTO THE 25 FOOT YARD SETBACK, IT STILL DOES MEET THE REGULAR R SF SEVEN. AND THEN THE PROPOSED PATIO WILL NOT EXTEND BEYOND THE SIDE OF THE HOUSE. BASED ON THAT STUFF, DOES RECOMMEND APPROVAL SUBJECT TO THREE CONDITIONS. ONE THAT THE HOUSE SHALL NOT ENCROACH ANY FURTHER INTO THE REQUIRED YARD SIDE, YARD, STREET SETBACK. NUMBER TWO, WITH THE EXCEPTION OF THE PROPOSED PATIO, NO OTHER EXPANSIONS INTO THE SETBACK SHALL BE PERMITTED. UM, WE DON'T HAVE A SPECIFIC DATES ON WITH THAT.
