PRIOR TO JOINING US, JOSHUA WORKED AS ASSISTANT, UH, DISTRICT ATTORNEY FOR GALVESTON COUNTY DISTRICT ATTORNEY'S OFFICE, WHERE HE PROSECUTED FELONY CRIMES IN THE 405TH DISTRICT COURT.

TONIGHT, AS CITY COUNCIL FACES THE CONVERSATION OF THE INSTALLATION OF LITHIUM BATTERY STORAGE FACILITIES, I SEE THAT YOU HAVE THREE CHOICES, ONE PAST THIS AND NOT KNOW WHAT YOU'RE GOING TO GET.

TWO, VOTE IT DOWN AND BE OVERWRITTEN BY THE STATE WHEN THEY GO TO THE LEGISLATURE AND STRIP YOUR ABILITY TO REGULATE IT OR THREE, POSTPONE IT AND COME UP WITH A SET OF STANDARDS.

IF YOU RECALL THE LAST TIME I SPOKE TO YOU, I ASKED YOU TO GET YOUR DUCKS IN ORDER.

AND THAT'S EXACTLY WHAT I MEAN.

POSTPONE THIS AND COME UP WITH A SET OF STANDARDS.

DO YOU KNOW WHAT TYPE OF LITHIUM BATTERIES THESE ARE? LITHIUM, NICKEL, LITHIUM COBALT, LITHIUM, IRON PHOSPHATE.

THERE ARE SIX TYPES OF LITHIUM BATTERIES.

WHICH ONES, IF YOU DON'T KNOW, HOW CAN YOU VOTE FOR THIS? DO YOU KNOW WHAT SAFETY MEASURES ARE IN PLACE TO HANDLE EMERGENCIES? SHOULD THEY OCCUR? WHO WILL TRAIN, WHO WILL SUPPLY SAFETY EQUIPMENT NOT ONLY TO OUR LEAGUE CITY VOLUNTEER

FIRE DEPARTMENT, BUT TO THE NEIGHBORING FIRE DEPARTMENTS WHO TYPICALLY ASSIST IN OUR EMERGENCIES? THIS NEEDS TO BE IN ORDER PRIOR TO APPROVING INSTALLATIONS.

DO YOU KNOW WHO OWNS THESE COMPANIES? WHO REALLY OWNS THESE COMPANIES? ARE THEY FOREIGN BORN DISGUISED AS AMERICAN COMPANIES? I ASK YOU TONIGHT TO POSTPONE ANY DECISION REGARDING LITHIUM STORAGE INSTALLATIONS UNTIL THEY HAVE BEEN RESEARCHED.

QUESTIONS HAVE BEEN ANSWERED, AND YOU FORM MINIMUM REQUIREMENTS FOR THE INSTALLATION OF LITHIUM BATTERY STORAGE AND SECURE SAFETY MEASURES FOR OUR RESIDENTS.

UM, SO FIRST BEFORE I GO INTO BESS, UH, I'M GONNA GO AHEAD AND COMMENT ON THE ITEMS ON THE AGENDA RELATED TO THE DRAINAGE, UM, PLANS FOR BRITTANY BAY, NEWPORT, THOSE AREAS.

UM, I AM A RESIDENT OF THE BRITTANY BAY SUBDIVISION, AND MY UNDERSTANDING IS THAT THIS APPEARS TO BE BEING REMOVED, UM, AND THE FUNDING REALLOCATED DUE TO, UM, A LACK OF AGREEMENT FROM SOME OF THE RESIDENTS IN THOSE SUBDIVISIONS THAT WOULD BE IMPACTED BY THAT, WHICH I UNDERSTAND IT'S GONNA IMPACT THEIR BACKYARDS.

BUT ALSO I HOPE THAT A DECISION THAT IMPACTS THE ENTIRE NEIGHBORHOOD IS NOT BEING MADE BASED UPON THE OPINIONS OF A FEW HOMEOWNERS THAT, YOU KNOW, MAY HAVE A LITTLE BIT OF AN INCONVENIENCE.

THE GOOD OF THE MANY OUTWEIGH THE NEEDS, THE FEW, UH, SO TO SPEAK.

SO, UM, JUST ONE THING TO CONSIDER THERE, THE NEEDS OF THE ENTIRE NEIGHBORHOOD.

UH, I'M NOT AWARE OF ANY CONVERSATIONS AT THE HOA LEVEL, BUT APPARENTLY THAT WAS COMMUNICATED, UM, WITH THE BEST, UH, I READ ALL OF THE SAFETY ANALYSES FOR THIS.

UH, CAN IT BE DONE SAFELY? ABSOLUTELY.

EVEN THE, THE REPORT THAT YOU ALL COMMISSIONED IN THAT AREA SAYS IT CAN BE DONE.

UH, I LOOK AT THINGS FROM THE PERSPECTIVE OF RISK.

THAT'S WHERE, WHERE I MY DAY JOB IS, IS RISK MANAGEMENT, RISK CONTROL.

UH, I, I LOOK AT THINGS AS YOU'RE MORE LIKELY TO DIE DRIVING TO THE STORE THAN MOST OF THE THINGS THAT WE'RE CONCERNED ABOUT HERE WITH THIS, THIS ISSUE.

UM, BUT I, I THINK GOING BACK TO STANDARDIZATION IS ALWAYS A GOOD THING AND THAT THERE'S REALLY LACK OF, UH, OR A NEED FOR THE CITY TO PUT FORTH SOME GUIDELINES THAT WOULD BE APPLIED CONSISTENTLY SO THAT WE'RE NOT TRYING TO REINVENT THE WHEEL WITH, YOU KNOW, IN-DEPTH ANALYSIS AND PLUME MODELS AND THINGS THAT REALLY PROBABLY SHOULD HAVE ALREADY BEEN DONE BEFORE, CONSIDERING WE ALREADY HAVE ONE OF THESE, THESE SYSTEMS HERE IN OUR CITY.

UM, TAKING THE TIME TO THOUGHTFULLY ANALYZE, LOOK AT WHAT BEST PRACTICES ARE, WHAT ARE THE NFPA CODES, UH, AND, YOU KNOW, PUT FORWARD SOME, SOME ORDINANCES THAT WOULD HELP TO GUIDE THE CONSTRUCTION OF THESE FACILITIES INTO THE FUTURE.

BECAUSE THE REALITY IS WE'RE NOT GONNA STOP THEIR CONSTRUCTION BECAUSE, AS WAS SAID, IF WE DECIDE TO TAKE A HARD LINE, THEY'RE GONNA FIND A, A LEGISLATOR WITH A OPEN EAR AND SOON YOU WON'T HAVE THE CONTROL OVER THIS.

SO, UH, TAKE A REASONED APPROACH, GO FORWARD AND PROVIDE WAYS TO ALLOW THEM TO DO THIS, BECAUSE ULTIMATELY IT'S GONNA HELP TO IMPROVE THE STABILITY OF OUR ELECTRICAL INFRASTRUCTURE.

I'M NOT SURE HOW MANY OF YOU WERE WITHOUT POWER DURING THE GREAT FREEZE, BUT YOU KNOW, EVERYBODY'S COMPLAINING ABOUT WANTING TO HAVE A MORE STABLE POWER GRID.

UH, THIS IS A STEP IN THAT DIRECTION.

I WOULD LOVE TO SEE MICRO NUCLEAR REACTORS IN EVERY SINGLE NEIGHBORHOOD.

THAT'S REALLY THE SAFEST LONG TERM.

BUT, UH, YOU KNOW, I'M SURE THAT PEOPLE WOULD BE UP IN ARMS ABOUT THAT IF THAT EVER HAPPENS.

BUT, UM, TAKE, I WOULD RECOMMEND TAKE THE TIME TO, TO PUT THIS ON PAUSE, UH, GET SOME SUBJECT MATTER EXPERTS TOGETHER TO DEVELOP SOME STANDARDIZED GUIDELINES TO HELP GUIDE YOU IN THESE DECISIONS GOING FORWARD.

SO AGAIN, ALSO THESE PROPERTY OWNERS KNOW WHAT'S EXPECTED WHEN THEY TRY TO COME FORWARD WITH THESE PROPOSALS IN THE FUTURE.

SO AGAIN, UM, THIS IS FOR A BATTERY ENERGY STORAGE SYSTEM, A SPECIAL USE PERMIT TO ALLOW THIS USE TO OPERATE HERE.

UM, SO JUST IN A GENERAL SENSE OF WHAT IS A BEST SITE.

UM, SO IT'S A GROUP OF BATTERIES THAT, UM, STORES ENERGY FROM THE ELECTRICAL GRID AND THEN RELEASES THAT ENERGY AT A FUTURE DATE.

AND SO THIS SPECIFIC SITE IS LOCATED ALONG 6 46, AND DURING TIMES OF LOW DEMAND OF THAT ENERGY, IT STORES THE ENERGY IN THE BATTERY CELLS, AND THEN DURING TIMES OF HIGH DEMAND, IT RELEASES THAT ENERGY BACK INTO THE ELECTRICAL GRID.

THE IDEA IS THAT THIS STABILIZES THE ELECTRICAL GRID AND REDUCES THE PEAKS AND VALLEYS, UM, THAT YOU SEE IN THE DEMAND.

SO FROM AN ELECTRICAL SUBSTATION STANDPOINT, IN LEAK CITY, WE HAVE SIX.

UM, I'M SURE YOU'VE HEARD OF, UM, SEVERAL SITES WANTING TO LOCATE A ADJACENT TO SEVERAL OF THESE SUBSTATIONS.

UM, BUT AGAIN, THE ONE WE'RE LOOKING AT TONIGHT IS ON THE EAST SIDE OF TOWN ON 6 46.

UM, SO THE SITE ITSELF IS CURRENTLY ZONED GENERAL COMMERCIAL.

UM, THERE WILL BE A REZONING NEEDED ALONG WITH THE SPECIAL USE PERMIT.

UM, THESE PRIVATE UTILITY USES ARE ONLY ALLOWED WITH THE SUP AND SEVERAL ZONING DISTRICTS.

THE ONE THEY'RE REQUESTING IS PUBLIC, SEMI-PUBLIC, WHICH IS CONSISTENT WITH, UM, OTHER UTILITY TYPE USES ARE LOCATED IN THAT ZONING DISTRICT.

UM, IT'S SURROUNDED BY COMMERCIAL PROPERTY.

AND, UM, THE CITY LIMIT LINE IS EVERYTHING TO THE SOUTH OF THIS PROPERTY IS IN GALVESTON COUNTY.

UM, WHEN WE LOOK AT THE PROXIMITY TO SINGLE FAMILY HOMES, UM, YOU GET YOUR FIRST HOUSE AT ABOUT A THOUSAND FEET FROM THE SITE.

UM, AND THAT'S IN THE HIDDEN LAKES SUBDIVISION.

UM, AND THEN WHEN YOU GET OUT TO 2000 FEET, YOU HAVE 129 HOMES IN HIDDEN LAKES AND THE WHISPERING LAKES RANCH SUBDIVISION.

THIS EXHIBIT SHOWS THE ENTIRE PROPERTY THAT, UM, THE PROPERTY OWNER HAS UNDER CONTRACT.

UM, THE SITE IN RED IS THE ACTUAL SITE THAT WILL BE REZONED.

THE REMAINDER WILL BE LEFT FOR COMMERCIAL DEVELOPMENT ABOUT 700 FEET, UM, FROM THE BEST SITE TO CAROLINE THAT WOULD BE DEVELOPED WITH COMMERCIAL IN THE FUTURE, ABOUT 330 FEET, UM, FROM 6 46, WHICH WOULD ALSO HAVE COMMERCIAL DEVELOPMENT IN THE FUTURE.

THIS IS THEIR, UM, PRELIMINARY LANDSCAPE AND SITE PLAN.

UM, SO STAFFS REQUESTED A BUFFER YARD SURROUNDING THE SITE, UM, THAT CONSISTS OF THE EIGHT TREES PER HUNDRED LINEAR FEET, UM, TO HELP SCREEN THE FACILITY AS WELL AS A CONCRETE WALL AROUND THE ACTUAL BEST FACILITY THAT WILL BE AT LEAST THE HEIGHT OF THE, OF THE CONTAINERS.

SO WHENEVER YOU LOOK AT THE SITE, UM, YOU WOULD SEE A CONCRETE WALL AND LANDSCAPING RATHER THAN THE ACTUAL, UM, CONTAINERS THEMSELVES.

AND SO AS A RESULT OF THIS, THERE WILL BE SOME, UM, PROPOSED UTILITY POLES ON THE SITE.

THERE'LL BE LOCATED ON THE SOUTH SIDE OF THE PROPERTY, UM, AGAIN, ALONG THE CITY LIMIT LINE AND DIRECTLY ADJACENT TO A HIGH POWERED POWER LINE CORRIDOR.

UM, AND THEN HERE'S SOME ILLUSTRATIONS OF THE SITE.

THIS WOULD BE LOOKING FROM CAROLINE, WHAT YOU SEE.

AND THEN THIS IS THE VIEW FROM 6 46.

OBVIOUSLY, AS TIME PROGRESSES, THIS VIEW WOULD CHANGE WITH COMMERCIAL DEVELOPMENT, UM, EVENTUALLY COMPLETELY SCREENING THE SITE FROM VIEW.

UM, THERE'S BEEN SOME TALK ALSO ABOUT THE VALUE OF THESE SITES AS WELL AS DEPRECIATION.

UM, SO WHEN WE LOOKED AT THE SEVERAL SITES IN GALVESTON COUNTY, UM, WE HAVE FOUND THAT THERE WAS ABOUT A 1.6% DEPRECIATION RATE YEAR OVER YEAR.

UM, THE APPLICANTS DID PROVIDE SOME DATA, WHICH, UM, PREDICTED A SUBSTANTIALLY HIGHER DEPRECIATION RATE ON THESE SITES.

UM, BUT FROM WHAT WE'VE SEEN IN PRACTICAL, UM, GALVESTON COUNTY EXAMPLES, WE HAVEN'T SEEN THAT HIGH DEPRECIATION RATE.

SO AGAIN, IT'S ABOUT A 1.6% RATE SINCE 2021.

SO, UM, JUST ROUNDABOUT SOME GENERAL FACTORS WE LOOK AT WHENEVER WE'RE CONSIDERING THESE.

UM, WE LOOKED AT THE LOCATION, UM, SO FOR THIS SPECIFIC LOCATION, IT'S NOT ADJACENT TO A MAJOR THOROUGHFARE.

IT'S KIND OF BACKED OFF THE ROAD OUT OF SIGHT AND DIRECTLY ADJACENT TO A HIGH POWERED POWER LINE CORRIDOR, UM, WHICH IS CONSISTENT WITH THEIR USE.

UM, FROM A ZONING STANDPOINT, UM, THEY ARE LEAVING SUFFICIENT ROOM FOR COMMERCIAL DEVELOPMENT TO SURROUND IT.

AND THE PUBLIC SEMI-PUBLIC

DISTRICT IS CONSISTENT WITH, UM, UTILITY USES LOCATING IN THEM.

UM, FROM A LIFE SAFETY STANDPOINT, I KNOW THIS IS A MAJOR CONCERN OF CITIZENS AND OF COUNSEL.

UM, SO THE CITY HAS PROCURED SERVICES FROM A THIRD PARTY, UM, EXPERT IN LITHIUM ION BATTERIES AND SAFETY, UH, OF THESE FACILITIES.

THEY PROVIDED A SAFETY REPORT FOR THIS SPECIFIC SITE, UM, THAT WAS INCLUDED IN YOUR PACKET.

AND, UM, WE HAD SOME CONDITIONS ADDED, UM, SINCE PNZ THAT, UM, WERE A RESULT OF THIS REVIEW AS WELL.

UM, FROM A, AND I'LL GO INTO A LITTLE MORE DETAIL ON THAT IN THE NEXT SLIDE.

FROM A VISUAL AND NOISE IMPACT, THERE'S REALLY NOT MUCH NOISE IMPACT.

WE DID A DECIBEL READING AT ONE OF THE EXISTING SITES AND IT'S BASICALLY AMBIENT NOISE, UM, ONCE YOU GET ABOUT 50 FEET AWAY FROM IT.

UM, SO THERE'LL BE NO REAL IMPACT THERE.

THE VISUAL IMPACTS, UM, WE'VE TAKEN CARE OF WITH THE SCREENING OF THE WALL AND THE ADDITIONAL LANDSCAPING WE'RE REQUESTING.

UM, DECOMMISSIONING, I KNOW THERE WAS A LOT OF TALK ABOUT DECOMMISSIONING AS WELL, AND WHAT HAPPENS 20 YEARS FROM NOW WHEN THESE BATTERIES ARE NO LONGER IN SERVICE AND THE COMPANY JUST LEAVES TOWN AND NOW WE HAVE A, YOU KNOW, BUNCH OF BATTERIES JUST SITTING THERE.

UM, SO AS PART OF THE CONDITIONS OF THE SUP, WE ARE REQUIRING A DECOMMISSIONING BOND.

SO THAT WILL REQUIRE A PROFESSIONAL ENGINEER GIVE AN ESTIMATE OF THE COST TO TAKE THE LAND BACK TO, UM, THE STATE IT'S IN TODAY.

AND THE APPLICANT WILL BE REQUIRED TO POST A BOND FOR THAT AMOUNT.

IT WILL INCREASE BASED ON INFLATION OVER THE 20 YEAR LIFE.

SO THAT WAY, EVEN IF THEY DO ABANDON IT, UM, WE'LL HAVE A WAY TO BRING THAT SITE BACK TO ITS CURRENT STANDARDS.

AND THEN OF COURSE, UM, THERE ARE INSURANCE REQUIREMENTS FOR THESE FACILITIES AS WELL.

I BELIEVE THEY HAVE A $5 MILLION POLICY.

UM, SO AS FAR AS THE SAFETY EVALUATION GOES, UM, AS I MENTIONED, THE CITY DID CONTRACT WITH A THIRD PARTY EXPERT, WE'RE NO EXPERTS IN LITHIUM ION BATTERIES.

UM, SO THIS GENTLEMAN IS, AND, UM, I JUST HIGHLIGHTED SOME MAIN POINTS, UM, OF HIS REVIEW.

THE, THE FULL, UM, REPORT WAS INCLUDED IN YOUR PACKET, BUT, UM, SOME, SOME BULLET POINTS.

IF THE BATTERY DOES ENTER A THERMAL RUNAWAY, THE EVENT WILL NOT PROPAGATE TO OTHER UNITS.

UM, IN THE EVENT OF A FIRE SHOULDN'T BE ANY WATER USED IN ATTEMPT TO EX EXTINGUISH THE FLAMES, THE ONLY WATER SHOULD BE USED TO PREVENT ANY FURTHER SPREAD OF THE FIRE.

THE 2024 VERSION ACTUALLY HAS SOME MORE STANDARDS RELATED TO THESE.

AND SO WE PUT A CONDITION ON THIS SUP THAT IT'LL BE REGULATED TO THOSE 2024 STANDARDS AS WELL AS THE NFPA 8 55, 20 23 STANDARDS.

AND THEN, UM, THEIR CONCLUSION WAS, OUR CURRENT CODES AND STANDARDS PROVIDE FOR THE SAFE DEPLOYMENT OF THIS BEST FACILITY AT THIS LOCATION.

UM, SO FROM A GENERAL STAFF FINDING, UM, WE FOUND THAT THE LOCATION IS APPROPRIATE FOR, UM, THE SURROUNDING.

IT, IT LEAVES APPROPRIATE ROOM FOR SURROUNDING COMMERCIAL DEVELOPMENT.

UM, THE PROPOSED REZONING IS CONSISTENT WITH THE COMPREHENSIVE PLAN.

UH, THE BEST WILL PROVIDE SUPPORT TO THE LOCAL ELECTRICAL GRID.

UM, THE, THE FACILITY WILL BE SCREENED WITH THE MASONRY WALL AND LANDSCAPING THAT WAS MENTIONED.

UM, THERE'S NO REAL EFFECT ON TRAFFIC.

THEY HAVE ONE GENTLEMAN THAT WILL COME SERVICE THE SITE, UM, ONCE A MONTH FOR ABOUT EIGHT HOURS.

SO THERE'S NO TRAFFIC GENERATED BY THE USE.

AND, UM, THE TAXABLE VALUE OF, OF THE PROPOSED FACILITY IS COMPARABLE TO THAT OF OTHER COMMERCIAL DEVELOPMENT ON A PER ACRE BASIS.

UM, SO WE PROVIDED SEVERAL, UM, CONDITIONS THAT I'VE MENTIONED THROUGHOUT THE PRESENTATION.

MOST OF THEIR DATA ON SAFETY GOES BACK NO FURTHER THAN 2018.

IT'S ALSO MY CONTENTION THAT IN THE NEAR FUTURE SODIUM ION BATTERIES WILL BE USED IN THESE TYPE OF FACILITIES.

SO I THINK THE CITY AND THESE DEVELOPERS ARE JUMPING THE GUN FOR A PROFIT MOTIVE, UH, AND GETTING AHEAD OF BOTH FIRE AND CITY REGULATION IN DEVELOPING THESE FACILITIES HERE NOW IN POPULATED AREAS AROUND SCHOOLS.

UM, THE CITY STAFF, UH, THEMSELVES JUST A LITTLE WHILE AGO, STATED THAT THIS FACILITY IS NOT BEING HELD TO THE 2001 CODES, BUT TO THE 2000, UH, EXCUSE ME, 2021 CODES, BUT TO THE 2024 CODES, THAT SHOULD TELL YOU RIGHT THERE NOW THAT CODES AND, AND, AND, UH, FIRE REGULATIONS ARE STILL BEING DEVELOPED ON THESE FACILITIES.
