UH, FIRST, UH, THING THAT WE NEED TO DO IS UNDER A HOLD THE PUBLIC HEARING AND TAKE ACTION ON VA DASH 23 DASH 0 0 0 5 MAC HIKE BUFFER YARD, A VARIANCE REQUEST FOR A MAXIMUM ACHIEVABLE BUFFER YARD ALONG THE EAST PROPERTY LINE ON 11.14 ACRE PROPERTY, GENERALLY LOCATED ALONG THE EAST SIDE OF THE FRONTAGE ROAD OF INTERSTATE 45 GULF FREEWAY, AND SOUTH OF LEAGUE CITY PARKWAY, WITH AN ADDRESS OF 2112 SOUTH GULF FREEWAY.

MARK, ARE YOU GOING TO, UH, DO THAT? YES, SIR.

SO, LONG STORY SHORT IS WE'VE BEEN, WE'VE BEEN IN CONJUNCTION WITH STAR TOYOTA SLASH MAC HIKE FOR, FOR MANY YEARS.

WHAT IS CAUSING THIS ISSUE NOW IS THAT A COUPLE MONTHS AGO STARTS, UH, I'M SORRY, MAC HIKE CAME FORWARD TO US SINCE THEY'RE, THEY'RE WANTING TO EXPAND THEIR SITE ONE MORE TIME WITH THAT.

THE ISSUE THAT HAS COME TO, TO PLAY IS THAT WE HAVE A REQUIREMENT IN THE ORDINANCE THAT AS A SITE EXPANDS BUILDING AND OR SITE EXPANDS OVER 25%, THEY TRIGGER THE REQUIREMENT THAT ALL LANDSCAPING HAS TO COME UP TO, TO THE CURRENT STANDARDS.

AND SO THE, WE'VE BEEN IN DISCUSSION WITH THEM, THEM, THEY'VE KNOWN ABOUT THIS SINCE 2016.

WE'VE HAD SOME DISCUSSIONS, BUT NOW THAT THE, THE, THIS BILLING THAT IS PROPOSED, UM, IT REALLY TRIGGERS THAT REQUIREMENT.

SO WE'VE BEEN DISCUSSING THAT THE TWO BIG ISSUES HAVE BEEN ALONG THE FRONTAGE ROAD, ALONG I 45 THAT WENT TO THE ZONING BOARD OF ADJUSTMENTS ON LES PAST THURSDAY AND WAS APPROVED UNANIMOUSLY.

UM, AND THEN WHAT IS BEFORE YOU TINNITUS FOR THE BUFFER YARD.

AND THAT IS ALONG THE EASTERN PROPERTY LINE.

CURRENTLY IT IS ADJACENT TO, UH, THE SPORTSPLEX.

HOWEVER, IN, IN SOMETIME DOWN IN THE FUTURE, WE DON'T KNOW HOW FAR THAT CAN POSSIBLY CHANGE.

SO WHAT WE'VE IDENTIFIED IS THREE LOCATIONS BASED ON THE BUFFER YARD.

AND YOU'LL SEE IN KIND OF HERE, YOU KNOW, WE'VE GOT AN AREA ONE, WHICH IS IN THE NORTHEAST QUADRANT, AREA TWO, JUST SOUTH OF THAT, AND AREA THREE, WHICH IS ABOUT THE CENTRALIZED LOCATION.

THE ISSUE WITH AREA ONE IS THAT THERE ARE OVERHEAD POWER LINES, SO IT REALLY DOESN'T MAKE SENSE THAT WHILE YOU CAN HAVE SHRUBS, WE DON'T WANNA NECESSARILY PUT TREES THERE BECAUSE THAT, THAT'S JUST A BIG NO-NO.

UM, THE AREA TWO, UM, MOST OF THE AREA IS ENCUMBERED.

THIS WHOLE EASTERN PROPERTY LINE IS ENCUMBERED BY A WATER LINE AS WELL AS IN THIS AREA THAT YOU'LL SEE KIND OF ON THE, THIS LEFT HAND SIDE HERE, BUT A KIND OF THE SOUTHERN PORTION OF AREA TOO.

THERE'S ACTUALLY A GATE.

UM, AND IF I CAN BACK UP JUST A SECOND, IF YOU'LL SEE HERE, YOU CAN SEE ON THE SCREEN YOU'VE GOT KIND OF A DRIVEWAY ON THE NORTHERN SECTION AND THE SOUTHERN SECTION THAT SOUTHERN, THAT SOUTHERN DRIVEWAY IS, IS BEING REMOVED CURRENTLY IS IN THE PROCESS.

AND WE'VE HAD DISCUSSIONS WITH THE OWNER, UH, OF MHY TO, UM, TURN THE NORTHERN GATE INTO AN, UH, HAVE AN AGREEMENT AND TO BASICALLY TURN THAT INTO AN ACCESS EASEMENT.

LONG-TERM THOUGHTS ARE, IS THAT IF THE SPORTSPLEX EVER GETS REDEVELOPED, THEN AS PART OF WHAT STAFF IS REQUESTING, THAT, THAT WILL EVENTUALLY GO AWAY AND THEN THAT WILL BECOME ADDITIONALLY AS PART OF THE BUFFERY YARD.

UM, ALL THIS BEING SAID, THE, THE REASON WHY THIS REQUEST HAS COME FORWARD IS BECAUSE THE UDC ALLOWS FOR A MAXIMUM WHAT'S CALLED A MAXIMUM ACHIEVABLE BUFFY YARD.

UM, THAT'S WHY YOU HAVE THE DIFFERENCE BETWEEN THE AREA BETWEEN, UH, ALONG THE FRONTAGE ROAD OF I 45, WHICH WAS A ZONING VARIANCE.

BASED ON THIS, THIS IS A MORE OF A SUBDIVISION VARIANCE BASED ON, UH, THE UDC.

AND THEN AREA THREE, UM, DEALS WITH THIS AREA.

AS YOU CAN SEE TO THE WEST OF THERE, THERE'S A BUILDING THERE, UM, REQUIRING THE FULL BUFFER YARD WOULD NARROW THAT ALLEYWAY, THAT ALLEYWAY AISLE, THE DRIVE AISLE BETWEEN THE BUILDING AND THE LANDSCAPING, WHICH WOULD PRESENT AN ISSUE BECAUSE THE FIRE MARSHAL'S OFFICE DOES NEED THAT AREA FOR FIRE PROTECTION.

SO STAFF DOES, UH, RECOMMEND APPROVAL WITH THE FOLLOWING CONDITIONS.

UM, NUMBER ONE IS THAT THE LANDSCAPE BUFFER YARD BE CONSISTENT.

THE APPROVAL IS CONSISTENT WITH WHICH WAS PROPOSED IN THE SHEETS L ONE, L 1.1, AND L 1.2.

AND THE SECOND PART IS UPON NOTICE OF THE CITY, OF LAKE CITY, THE APPLICANT SHALL RECONFIGURE THAT NORTHERN DRIVEWAY AS PREVIOUSLY DISCUSSED, WHICH IS ALSO ON THAT DETAIL.

SO THAT WAY, WHETHER IT'S, YOU KNOW, SIX MONTHS FROM NOW, FIVE YEARS FROM NOW, 10 YEARS FROM NOW, IT HAS ALREADY IDENTIFIED THAT THAT INSET CAN BE UTILIZED.

AND THAT'S WHAT THAT, UH, PART OF THAT AREA TOO WILL BE ADDRESSED AS, AS PART OF THE BUFFER YARD.

THE APPLICANT, A REP, UH, REPRESENTATIVE ON BEHALF OF THE OWNER IS HERE FOR QUESTIONS AND I'M AVAILABLE FOR QUESTIONS AS WELL.

IS THERE ANYONE IN THE AUDIENCE THAT, UH, WOULD LIKE TO ADDRESS THE COMMISSION OR DO ANYBODY HAVE QUESTIONS OF THE OWNER OR, OR ON THE, I, I HAVE A FEW QUESTIONS.

SO WHAT, WHAT IS THE, UH, MINIMUM WIDTH OF THE ROAD THAT THE FIRE MARSHAL REQUIRES FOR ACCESS? I BELIEVE THE DRIVE VI FOR FIRE LANES IS 26 FEET.

AND I DO KNOW THAT IN DISCUSSIONS WITH THEM THAT WHAT IS BEING PROPOSED, IT'S WHAT'S EXISTING.

AND SO THEY DID NOT REQUEST ANY ADDITIONAL FIRE LANE.

'CAUSE THAT, THAT'S WHERE I WAS GOING WITH THAT IS, IS DOWN AT AREA THREE AT THE MAIN BUILDING.

THEY'VE GOT WHAT APPEARED TO BE LIKE 25 FEET FROM THE, I'M ASSUMING FROM THE EDGE OF THE BUILDING TO THE, TO THE BUFFER.

I DON'T KNOW WHICH IS THE EDGE OF THE BUILDING, IF IT'S WHERE THE 65.3 IS OR IF IT COMES OUT TO WHERE THE ZERO IS AT.

SO I MEASURED IT FROM THE ZERO.

IS THAT ACCURATE? ROUGHLY? I'D HAVE TO, I DON'T HAVE THAT SCALE IN FRONT OF ME, BUT ROUGHLY.

OKAY.

I I, I SCALED THEM AT WORK TODAY, SO THAT'S WHY, THAT'S WHY I'M ASKING.

'CAUSE AT SOME POINTS DOWN IN THE OTHER AREAS, UM, YOU HAVE, UH, 17 FEET PER ROADWAY.

SO THAT'S WHY I'M ASKING WHAT THE, WHAT THE CRITERIA IS.

SO IF IT'S 17 AT ONE DRIVEWAY AND IT'S 25 AT THE OTHER AND THERE, AND THE FIRE MARSHAL REQUIRES 25 FEET, THAT DOESN'T ADD UP TO ME.

THE, ALSO, JUST FOR INFORMATION, THE DRIVE VI DOES CHANGE.

SO FOR EXAMPLE, A DRIVE VI WHEN IT'S ADJACENT TO, UH, LIKE A FIRE LANE, MM-HMM.

, TYPICALLY FIRE MARSHAL REQUIRES 26 FEET DRY VIALS WHERE IT'S ADJACENT TO, UM, 90 DEGREE PARKING IS 25 FEET BECAUSE WE HAVE TO HAVE THAT FOR BACKUP SPACE.

IF IT IS JUST DRY VIAL ITSELF, NOTHING ELSE AROUND IT.

IT CAN BE DOWN TO, I BELIEVE, 20 FEET.

UM, THE OTHER PART IS WITH THE 17 FEET, I'M NOT SURE ABOUT THAT WITHOUT, WITHOUT THE, THAT IS OVER IN, UH, AREA TWO.

AREA TWO THAT I WOULD HAVE TO GO BACK AND LOOK AT THAT BASED ON THE REGULATIONS AT THE TIME THAT THAT REGULATION CAME INTO PLACE.

'CAUSE WHERE, WHERE I'M, WHERE I WAS GOING WITH THAT, OBVIOUSLY WITH THE UTILITY, SO IF YOU, IF YOU'VE GOT THESE EVERGREEN TREES, WHICH THEY'RE ALL DOWN THAT BACK LINE EXCEPT FOR AREAS ONE, TWO, AND THREE, YOU KNOW, OBVIOUSLY WITH THE FIRE LANE, THAT'S WHY I WAS ASKING WHAT THE DISTANCE WAS BECAUSE YOU COULD COME STRAIGHT ACROSS AND STILL PUT THE EVERGREEN TREES.
