ITEM A, HOLD A PUBLIC HEARING AND TAKE ACTION ON A ZONING BOARD OF ADJUSTMENTS. APPLICATION VA DASH 23 DASH ZERO FOUR MAC HIKE, UH, LANDSCAPE SETBACK. A VARIANCE REQUEST TO DECREASE THE REQUIRED 10 FOOT LANDSCAPE SETBACK ALONG PUBLIC ROADWAY. FRONTAGES ON PROPERTY LEGALLY DESCRIBED AS LOT ONE OF THE STAR COMMERCIAL REPL, GENERALLY LOCATED ALONG THE EAST SIDE OF THE FRONTAGE ROAD TO INTERSTATE HIGHWAY 45 GULF FREEWAY AND SOUTH OF LAKE CITY PARKWAY WITH THE ADDRESS OF 2112 SOUTH GULF FREEWAY. UM, THE RESULT OF THIS VARIANCE REQUEST STEMS FROM A UDC REQUIREMENT THAT SAYS, AFTER A SITE HAS BEEN ESTABLISHED AND IT EXPAND EITHER THE SITE OR BUILDING SIZES, EXPAND OVER 25%, THAT ONCE YOU PASS THAT SURPASS THAT THRESHOLD THAT THE ENTIRE LANDSCAPING HAS TO COME UP TO THE REQUIREMENTS. THIS WAS FIRST BROUGHT UP, UM, TO THE OWNERS AND THE OWNERS' REPRESENTATIVES BACK IN 2016. SO THIS IS SOMETHING THAT WE'VE DEFINITELY BEEN DISCUSSING FOR A WHILE. UM, WHAT IS TRIGGERING IT NOW IS THAT THEY'RE WANTING TO EXPAND ANOTHER BUILDING ON THE, AND THE SOUTHEAST QUADRANT OF THE PROPERTY. UM, AS YOU CAN SEE, JUST UNDER THE, UH, AREA OF WHERE IT SAYS L 1.1 FOR THE SHEET, L 1.1, AND THAT IS THE PROPOSED LOCATION OF THE NEW BUILDING. THAT BUILDING WOULD EXCEED THAT 25 PER PERCENT THRESHOLD. AND SO THEREFORE, THAT HAS TO COME UP TO THE CURRENT STANDARD. SO IN DISCUSSIONS WITH THE OWNER'S REPRESENTATIVE, THE, THE TWO LARGE ISSUES WITH THE DEVELOPMENT, ESPECIALLY JUST, YOU KNOW, DEALING WITH AN EXISTING SITE AND TRYING TO, UH, YOU KNOW, REDEVELOP IT AND MEET THE REQUIREMENTS, IS THAT, UH, THERE'S AN AREA, UH, THE FIRST AREA IS, AS YOU SEE HERE, THAT IS GONNA UNDER CONSIDERATION TONIGHT, WHICH IS ALONG THE FRONTAGE ROADS, AND THAT'S THE FRONTAGE I 45 AS WELL AS LAKE CITY PARKWAY. THE OTHER ISSUE, WHICH WILL BE CONSIDERED BY THE PLANNING AND ZONING COMMISSION ON MONDAY IS ACTUALLY ON THE EAST SIDE OR AT THE BOTTOM OF THE, UH, PRESENTATION SLIDE, WHICH WILL BE FOR THEIR BUFFER YARD. AS YOU CAN SEE HERE, THE, YOU KNOW, AS FAR AS, UM, HAVING DISCUSSIONS AND WORKING THROUGH THE PROCESS, THE, THE VARIANCE THAT IS BEING REQUESTED IS RELATED TO JUST THE SPECIFIC CENTRALIZED AREA. UM, AS YOU CAN SEE KIND OF ON THE INSET HERE, THIS AREA IS KIND OF CONSTRAINED IN, IN SEVERAL INSTANCES. ONE, THERE WAS A, A PREVIOUS TXDOT ACQUISITION AS PART OF THE EXPANSION. ALSO, UH, BASED ON THE EXISTING SITE, THE EXISTING VEHICLE SHOWROOM AND PARTS AND SERVICE BUILDING, IT DOES KIND OF CREATE A CONSTRAINED AREA WHERE IT WOULD BE DIFFICULT. AND SO THAT IS THE MAIN KIND OF THRUST, IF YOU WOULD SAY, OR THE MAIN AREA OF FOCUS FOR THE VARIANCE REQUEST. UH, BASED ON STAFF'S FINDINGS. UM, [00:05:01] YOU KNOW, IT DOES, YOU KNOW, STAFF HAS THE CRITERIA MAY MEET ALL OF THE CRITERIA. UH, THE, UH, PRESENTED IN THE STAFF REPORT, THE PROPERTY IS SUB, WAS SUBJECT TO THE EXPAN, UH, TO THE EXPANSION OF I 45 BY TXDOT. AND THAT, UM, FULL, UH, APPLICATION OF THE RE THE REQUIREMENTS, YOU KNOW, ESSENTIALLY THE DENIAL OF THE VARIANCE WOULD CREATE AN UNNECESSARY HARDSHIP. AS A RESULT, STAFF DOES RECOMMEND APPROVAL SUBJECT TO THE TWO AREAS SHOWN IN ATTACHMENT FOUR, THAT THEY BASICALLY BE, UM, DESIGNED AND CONSTRUCTED AS SHOWN ON EXHIBIT FOUR. I'M AVAILABLE FOR ANY QUESTIONS. THE APPLICANT IS HERE. SHOULD YOU HAVE ANY QUESTIONS AS WELL. THE, THE AREAS THAT YOU'RE, YOU'RE TALKING ABOUT FOR CLARIFICATION ARE THE CLOUDED AREAS HERE? YES, THEY'RE THE CLOUDED AREAS. AND THEN ON THE INSET, YOU CAN KIND OF SEE WHERE IT KIND OF DIPS BELOW THE 20 FOOT REQUIREMENT. SO THESE ARE THE TWO AREAS, PARTICULARLY IF YOU NOTE, YOU KNOW, IN KIND OF THE ZOOM IN HERE, THAT THESE ARE THE PARTICULAR AREAS SUPER CLOSE TO THOSE STRUCTURES. SO OBVIOUSLY IT'S DIFFICULT TO MOVE THE STRUCTURE, YOU KNOW, COST PROHIBITIVE BECOMES REALLY UNFEASIBLE FROM A, FROM A STANDPOINT OF TRYING TO MEET THE INTENT WHEN COMBINED WITH THE ISSUES WITH THE TXDOT ACQUISITION. SO ARE THE GRAY LINES WHERE THE PROPERTY WAS BEFORE TDOT CAME IN? I BELIEVE THE GRAY LINES ARE ACTUALLY SHOWING THE RIGHT OF WAY BECAUSE THERE'S STILL A KIND OF A GREEN SPACE THAT IS ALONG THE ROADWAY. IF YOU DRIVE ALONG THE FRONTAGE ROAD. UM, THEY'RE JUST REFLECTING. SO THE, THE, THE BLACK LINE REFLECTS THE NEW ACQUISITION. WHAT A GOOD, PROBABLY A GOOD WAY TO SHOW YOU IS IF YOU LOOK ON THE AERIAL AND LOOK ON THE ZONING MAP, YOU CAN KIND OF SEE WHERE IT FLARES OUT IN THE MIDDLE OF THE SITE. THAT WAS THE ACQUISITION. THE ACQUISITION WAS ONLY ABOUT A 12,000 SQUARE FOOT, BUT IT WAS, YOU KNOW, ABOUT 10 TO 12 FEET AND WIDTH FOR ABOUT 300 FEET. SO THE STRETCHES ALONG THE, THEY BASICALLY STRETCHED IT ALONG THE ENTIRE FRONT. THEY TOOK MOST OF A MAJORITY OF THE FRONTAGE ALONG THE RIGHT, THE RIGHT OF WAY, THE FRONT RIGHT OF WAY. OKAY. SO THAT WAS DEFINITELY NOT OF THEIR DOING. YEAH. OKAY. AND IF, AND IF THAT ACQUISITION BY TXDOT HAD NOT HAPPENED AND WITH THIS EXPANSION, THEN THERE WOULDN'T BE AN ISSUE TO DEAL WITH. THERE WOULD BE, THERE WOULD BE 10 TO 12 MORE FEET TO, TO USE THAT EXPANSION FOR, TO MEET THAT REQUIREMENT. OKAY. THANK YOU. ANY, ANY FURTHER QUESTIONS FOR STAFF? OKAY.
